California HOA Fines Residents Over U.S. Flag Display

Homeowners in San Marcos, California, are challenging their homeowners association's policy that threatens fines for displaying the U.S. flag, citing freedom of expression and legal protections.


Amy Cooke and her husband have flown the American flag outside their condominium for over two decades. However, their association, Ambiance Owners Assn., is now threatening a $100 fine, asserting that the display violates community rules. Cooke has stated her intention to contest the association's stance, emphasizing the flag's symbolism of freedom and questioning the message sent to those serving the country.


The conflict arose after the HOA enacted a policy prohibiting flags, signs, or banners in common areas in 2024. While initially perceived as targeting sports or political displays, residents soon received notices concerning the American flag. Terri Collins, another resident, has already been fined $100, which she has refused to pay, viewing the flag display as a patriotic tradition that will not be intimidated.


In a memo from October 2024, the HOA's board of directors claimed the ban was for the community's benefit, stating that allowing one owner to express political views via a flag could lead to other owners doing the same, thereby degrading common areas. The policy restricts flags in common areas or those extending into them, allowing only one flag per household in exclusive use common areas, with size limitations.


State and federal laws, including the Freedom to Display the American Flag Act of 2005, protect residents' right to fly the U.S. flag on their private property, though HOAs can regulate the manner of display. California law similarly restricts organizations from banning flag displays within exclusive use common areas, except for public health or safety reasons. The HOA's assertion that Cooke's flag mount is on "HOA common area fascia" is being contested, with experts suggesting such an interpretation could lead to legal challenges and potential lawsuits.


A GoFundMe campaign initiated by Cooke to cover legal expenses had raised over $2,700 as of Wednesday afternoon. David Keating of the Institute for Free Speech commented that the HOA's attempt to enforce such a ban is likely to face significant legal opposition and public criticism, particularly as the nation approaches its 250th anniversary.
