FIFA Mandates Release Clauses in Transfers from 2027

FIFA is set to overhaul football's transfer system starting January 1, 2027, introducing a landmark regulation that will require release clauses in all player contracts. This significant change follows a substantial court settlement with former Real Madrid and Chelsea midfielder Lassana Diarra.


The new rules, announced late Wednesday, stem from a lengthy legal dispute where Diarra settled with FIFA for an undisclosed sum earlier this year. Diarra had sued FIFA for approximately €64 million after unilaterally terminating his contract with Lokomotiv Moscow in 2014 and not receiving his due compensation. This settlement appears to have directly influenced the upcoming alterations to football's contract laws.


Under the new regulations, players earning less than €150,000 annually will receive a fixed 5% of any transfer fee they are involved in, as compensation for the remainder of their contract. The system will also establish a clear method for calculating compensation when a player unilaterally rescinds their contract, with the minimum payout being the value of the remaining contract term.


A pivotal aspect of the reform is the mandatory inclusion of release clauses in all contracts, requiring both the player and the club to agree on a predetermined transfer fee, mirroring the existing system in Spain. Additionally, clubs will gain more control over their homegrown talent, with the ability to offer youth players under 18 contracts lasting up to five years, an increase from the current three-year limit, provided these players have progressed through the club's own academy system.


While many top clubs already implement extremely high release clauses, and the practice has become more common across the sport in recent years, these changes are expected to grant players greater agency over their career paths. The reform could potentially reshape transfer dynamics, particularly within leagues like the English Premier League.
